E-2 or EB-5: what to compare before you decide?

E-2 and EB-5 show up in searches about investment in the United States, but they are not equivalent alternatives. The E-2 is a temporary classification for eligible investors from treaty countries. The EB-5 is part of the immigration categories related to investment and can lead to permanent residence when its requirements are met.

Start with the immigration goal

The first question is what you intend to build: what your role in the business will be and how that relates to your residence plans. The choice should not be made only by the amount advertised in an investment offer. Each option requires its own review.

Nature

E-2. Temporary

EB-5. Immigration category

Nationality

E-2. Requires eligibility through a treaty country

EB-5. Does not use the same treaty condition as the E-2

Focus of the review

E-2. Investment and direction of the company, according to the category

EB-5. Qualified investment and job creation

Permanent residence

E-2. Is not the same as a green card

EB-5. Can lead to residence when the requirements are met

Separate the legal review from the financial decision

An immigration classification does not, by itself, show the economic quality of a project. Before you take on commitments, discuss the investment structure, the documents, and the questions that should go to the professionals responsible for the financial review.

Bring concrete questions to the consultation

Which requirements need to be shown? What information is missing about the project? How will family planning be considered? Which steps and costs should be listed? What depends on legal review or on third parties? Those questions help you assess the path with more clarity.
